The short answer
Whether a sweepstakes casino is legal depends on your state. There is no federal law that authorizes them, and no state licenses them as casinos. As of October 4, 2026, nine states have laws banning online sweepstakes casinos in force, a tenth (Oklahoma) has a ban taking effect on November 1, 2026, and attorneys general and regulators in several other states, including Florida, Kentucky, Maryland and Michigan, have sent cease-and-desist letters or filed lawsuits. In the remaining states, operators continue to offer Sweeps Coin play under their own sweepstakes rules, and each operator also excludes states of its own choosing.
The legal theory, and the case against it
Why operators say the model is lawful. State gambling and lottery laws generally require three elements: a prize, chance and consideration. A promotional sweepstakes keeps the first two but removes consideration by offering a free method of entry with “equal dignity”, according to Klein Moynihan Turco. Operators argue that players buy Gold Coins for entertainment and receive Sweeps Coins free, with a mail-in request available to anyone. The Social Gaming Leadership Alliance, whose members as named in June 2025 included VGW, B-Two Operations, Yellow Social Interactive and ARB Interactive, calls the model marketing rather than gambling and asks states to regulate rather than ban it (SGLA).
Why states disagree. Regulators look at what players actually do. New York’s Attorney General said VGW falsely claimed Sweeps Coins were free, finding that players received approximately one coin per dollar spent (NY AG; our settlement report). Florida’s Attorney General called the dual-currency model intentionally designed to disguise real-money gambling (Florida AG; our coverage of the Florida suits). Several of the new statutes, including California’s and New York’s, target dual-currency games by name, which leaves the free-entry argument little room in those states.

Two related laws are not sweepstakes-specific bans, and both rows rely on secondary reporting. Nevada’s SB 256 (2025) strengthens penalties for unlicensed gaming, including disgorgement and reach to out-of-state operators. Iowa’s SF 2289, effective July 1, 2026, lets the Racing and Gaming Commission issue cease-and-desist orders and seek injunctions against sweepstakes operators.

- Pennsylvania HB 2801, introduced on September 24, 2026, would ban online sweepstakes games and assisting them, with fines of $50,000 to $500,000 per violation. It sits in the House Gaming Oversight Committee, according to Gambling Insider; we have not yet confirmed the details on the legislature’s site. High 5 already restricts Pennsylvania.
- District of Columbia B26-0656, the Internet Gaming and Consumer Protection Act of 2026, would legalize online casino gaming and ban sweepstakes casinos. It is under Council review, according to InfoLawGroup.

What happens to your coins when your state bans sweepstakes casinos
Exits so far have followed the same three steps: Gold Coin sales stop, Sweeps Coin play stops, and a final window opens to redeem eligible coins. VGW ended Sweeps play in West Virginia on November 18, 2025 and redemptions on November 25, 2025, according to CasinoBeats. When VGW closed LuckyLand Slots outright, purchases ended August 3, 2026, play on August 24 and redemptions on September 14, 2026, according to Gambling Insider (LuckyLand closure timeline).
If you are in Oklahoma or another state with a ban approaching:
- Complete identity verification now, so a redemption is not held up at the deadline.
- Meet playthrough on any balance you intend to redeem, and check it clears the minimum.
- Stop buying Gold Coins. They have no cash value, and any Sweeps Coins bundled with a late purchase still need playthrough before the redemption deadline.
- Watch your email and the operator’s notices for the exact dates.
Some operators keep a Gold-Coin-only mode in ban states. Global Poker, for example, offers Gold Coins only in ten states, including California and New York (Global Poker). Those coins have no cash value.
